A jury returned a guilty verdict on Tuesday against 36 year-old Danny Ray Lusk for sexual misconduct involving two children.
Henderson County District Attorney Scott McKee said the punishment phase of the trial which began May 14 was set to begin Tuesday in Judge Mark Calhoon’s 3rd District Court.
Lusk, of Athens, was found guilty of two counts of aggravated sexual assault of a person under the age of 14 and two counts of illegal contact.
To qualify as sexual assault of a person younger than 14 years of age, the actor must be 17 years of age or older. An offense under this section of the penal code is a felony of the first degree, punishable by imprisonment in the Texas Department of Criminal Justice for life, or for a term of not more than 99 years or less than 25 years.
Nancy Ruman prosecuted the case for the Henderson County District Attorney’s Office. The defense was represented by Brad Stevens.
Lusk was arrested in April 2011 on the first sexual-abuse charge for an event that occurred in October 1999. He was indicted for the charge in September.
After further investigation, Lusk was arrested again in February 2012 for an additional sexual abuse incident that reportedly occurred in May 2001.
