SOS clarifies rule on who can vote in primary runoff

Sheriff’s candidates headed for another vote April 8

Henderson County voters still have one more decision to make before the 2004 Primary Election is put to rest.

Voters will return to the polls April 8 to decide the Republican Party candidate for Henderson County sheriff. A runoff between Ray Nutt and Tony Allison will be held after a pool of three candidates, including Mitch Baker, failed to get at least 50 percent of the vote Tuesday. Nutt received 4,225 votes, or 46.99 percent, while Allison held off Baker to get 2,453 votes, or 27.28 percent. Baker got 25.73 percent, or 2,314 votes.

The winner will face Democrat Bill Casey in November.

Any registered voter who did not cast a ballot in the Democrat Primary March 4 can participate in the runoff. That includes those who voted in the Republican Primary.

According to Scott Haywood of the Texas Secretary of State Elections Division, those who voted in either party’s primary are prohibited to cross over and cast a ballot in the other party’s runoff. However, there is still time for someone who had not registered for the primary to take part in the process.

“You have to be registered by March 10,” Haywood said.

An abbreviated period of early voting will precede the election. Early balloting begins April 1 and runs through April 4.

More than 9,000 voters cast ballots in the Republican Primary. With no presidential primary and only one race to be decided, the first challenge for Allison and Nutt will be to get those who voted for them March 4 to return to the polls.

According to the Texas Politics Web site, in a race with three or more candidates, most states award the primary win to the candidate who receives a plurality of the votes. Texas’s requirement for a majority is a legacy of the days when the state was dominated by the Democratic Party. Often the Democrats would field several viable candidates for a seat. Runoffs were instituted to ensure a winner suitable to a majority of the voters.
