Athens —
A 38-year-old Athens man, charged with intoxicated manslaughter after allegedly driving into two pedestrians and killing one, was indicted by a Henderson County Grand Jury last week.
Athens Police Department reports of the Oct. 6, 2012, accident state Charles Lee Linton was driving a Dodge pickup on Farm-to-Market Road 2495 when he veered into the grass beside the roadway. The vehicle struck Kelby Ball, 22, and Anna Latham, 19, who had left Lake Ridge Apartments headed for a service station at the intersection of East Tyler Street and FM 2495.
Ball was pronounced dead at the scene. Latham was transported to East Texas Medical Center in Athens, then flown to Tyler by helicopter with non-life-threatening injuries.
APD reports stated a witness to the accident called 9-1-1. Police found Linton inside the truck, parked on the northeast side of the Walmart parking lot. According to police, damage to the pickup was consistent with evidence found at the wreck location.
The Texas Penal Code lists intoxication manslaughter as a second-degree felony, punishable upon conviction by a term of two to 20 years in prison, and a fine not to exceed $10,000.
