Man convicted of sexual assault of his own daughter

Athens — It took less than 30 minutes for a Henderson County jury of 11 women and one man to sentence Horace “Joe” Barker, 47, of Athens, to life in the Texas Department of Corrections Friday, after that same jury convicted him of Aggravated Sexual Assault late Thursday night.  

The trial, which began Tuesday morning, was held in Judge Carter Tarrance’s 392nd District Court. Assistant District Attorneys Nancy Rumar and Jenny Huckle prosecuted the case on behalf of Scott McKee’s District Attorney’s Office.

The conviction stems from the 2003 Aggravated Sexual Assault of a 6-year-old child.  The trial began with testimony from the victim and her mother. 

The victim described for the jury in detail how Barker, the victim’s own biological father, forced her to have intercourse with him.

Shelia Durden of the Henderson County Help Center, and Investigator Michael Shelley of the Henderson County Sherriff’s Office, also testified during the trial.

During sentencing, the jury also heard evidence that the defendant was previously convicted in 2007 of Sexual Assault of a 14-year-old girl, and had physically abused several women that he had been in relationships with over the course of 20 years.

In their closing arguments to the jury, both Rumar and Huckle referred to Barker as a dangerous man, with violent tendencies toward women and girls, before asking the jurors to remove him from society.

“I would certainly consider this poetic justice,” said District Attorney Scott McKee.  “This defendant has spent his adult life abusing women and young girls, and now 13 women (two prosecutors and 11 jurors) have removed him from our community.” 

McKee indicated that he is proud of the work the Henderson County Child Advocacy Center and Ray Nutt and his department did on this case. 

“We have worked hard over the past four years to approach these types of cases from a team perspective, and today it paid off.”

  • Athens house burned

    A Monday afternoon fire inflicted severe damage to a house at 911 W.  Cayuga Dr. in Athens.
    No one was injured in the blaze that started in the back bedroom of the residence. Athens Fire Chief John McQueary said the resident had been staying with her sister and was not at home at the time of the blaze. The cause of the fire is under investigation.

    If you’ve noticed some big black bugs gathering outside your home or crawling along the carpet, you’re just seeing evidence of the large number of ground beetles now in East Texas.
    “The ground beetles are not rare, but the population of them that we’re seeing now is uncommon,” Henderson County AgriLife Extension Agent Rick Hirsch said. “This is the heaviest population of ground beetles that I’ve seen in my 20-plus years in Henderson County.”
