HSCO arrests man for shooting his daughter

An argument between a father and a daughter in Cherokee Shores turned into gunfire on Saturday.

The altercation sent the woman to the hospital with minor injuries according to Henderson County Sheriff Ray Nutt.

Gary Wayne Payne, 59, was booked into the Henderson County Jail on a charge of aggravated assault with a deadly weapon.

He remained jailed Monday, with bond set at $75,000.

Nicole Montana, 29, was transported by ambulance to East Texas Medical Center Gun Barrel City, then flown by helicopter to ETMC Tyler. She was treated and released.

Henderson County Sheriff’s Department dispatch received a call at 10:45 p.m., reporting a shooting at Montana’s residence on Kokomo Street. Deputies Richard Miller, Ronny Snow and Josh Rickman, along with District Attorney’s Office Investigator Baldeman Quintanilla went to the residence and discovered that Montana had been wounded in the leg and foot.

HCSO Investigator Bryan Tower, Nutt, Chief Deputy Dan Parker, Major Kevin Hanes and Captain Kay Langford were called to the scene. Officers were told that an argument had taken place between Montano and Payne.

When the argument escalated, Payne left his daughter’s residence and went to his home next door. Payne soon returned with a 12 gauge shotgun and began firing.

Nutt called out the HCSO Tactical Team. The team entered Montana’s house and located Payne, still inside.

Payne was arrested without incident.

The shooting is under investigation.
