Kerens Police Chief Wesley Bryan Miers is back at work, after being reinstated Wednesday, according to Kerens City Secretary Cindy Scott.
Miers was suspended from work on July 2, pending the outcome of allegations that he committed a misdemeanor family assault.
He won’t be prosecuted for the charge, confirmed Clint Davis, Henderson County Attorney.
Because Miers was formerly an officer with the Henderson County Sheriff’s Office, many of his cases are still pending in those courts, so the district court appointed an outside lawyer as special prosecutor in the case, Davis explained.
John Meskunas, the special prosecutor assigned to the case, declined to prosecute the case because there was a lack of sufficient evidence. Because the allegation was a misdemeanor it would not go to the grand jury.
Kerens Mayor Jeffrey Saunders said the case turned out as expected.
“It was unfortunate, but we knew the details and we were confident it would turn out this way,” Saunders said Thursday.
